1. Definitions

• "Platform" refers to the TutorHubBd website and mobile application.
• "Tutor" refers to an individual registered on the platform to provide tutoring services.
• "Student" refers to an individual registered on the platform to receive tutoring services.
• "User" refers to any individual who accesses or uses the platform, including tutors and students.
• "Services" refers to all features, content, and functionalities offered on the platform.

2. Account Registration

To access certain features of the platform, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and update your account information promptly
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 18 years old to create an account. If you are under 18, you may use the platform only with the involvement and consent of a parent or legal guardian.

3. User Conduct

As a user of our platform, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Provide false, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your affiliation
• Harass, threaten, intimidate, or harm other users
• Post or transmit any offensive, defamatory, or discriminatory content
• Interfere with or disrupt the platform's security or functionality
• Attempt to gain unauthorized access to any part of the platform
• Use the platform for any illegal or unauthorized purpose
• Engage in spamming, phishing, or other fraudulent activities
• Reverse engineer, decompile, or disassemble any part of the platform

4. Tutoring Services

For Tutors:

• You represent that you possess the qualifications, experience, and credentials you list on your profile
• You agree to provide tutoring services professionally and to the best of your ability
• You must maintain professional conduct during all sessions
• You are responsible for your own tax obligations as an independent service provider
• You may not transfer your tutoring obligations to another person without prior consent

For Students:

• You agree to attend scheduled tutoring sessions punctually
• You must provide at least 24 hours' notice for cancellations
• You agree to pay all fees associated with the services you book
• You must maintain respectful conduct toward tutors during all interactions

5. Fees and Payments

Use of certain features of the platform may require payment of fees:

• All fees are clearly displayed before you confirm a transaction
• Payments are processed securely through SSLCommerz
• Subscription plans auto-renew unless cancelled before the renewal date
• Refunds are handled according to our Refund Policy as described on the platform
• We reserve the right to change our fee structure with reasonable notice
• All fees are inclusive of applicable taxes unless stated otherwise

6. Cancellation and Refund Policy

• Sessions: Students may cancel a session up to 24 hours before the scheduled time for a full refund. Cancellations within 24 hours may be subject to a fee.
• Subscriptions: You may cancel your subscription at any time. Access will continue until the end of the current billing period.
• Refund Processing: Approved refunds will be processed within 5-10 business days to the original payment method.

7. Intellectual Property Rights

The platform and its original content, features, and functionality are owned by TutorHubBd and are protected by international copyright, trademark, and other intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from our platform without our express written consent
• Content posted by users (tutor profiles, reviews, etc.) remains the property of the respective user, but you grant us a license to display and distribute it on the platform
• Our name, logo, and brand elements are our trademarks and may not be used without permission

8. Privacy and Data Protection

Your use of the platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the platform, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, TutorHubBd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, or goodwill
• Service interruption or computer damage
• Cost of procurement of substitute services
• Any matters beyond our reasonable control

Our total liability for any claim arising from these terms or the use of the platform shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding:

• The platform's uninterrupted or error-free operation
• The accuracy, reliability, or completeness of any content
• The quality, safety, or legality of tutoring services provided by tutors

TutorHubBd is a marketplace platform connecting tutors and students. We do not directly provide tutoring services and are not responsible for the conduct of tutors or students during sessions.

11. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended period of inactivity
• At our sole discretion, with or without cause

Upon termination, your right to use the platform ceases immediately. Sections 5, 7, 9, 10, 12, and 14 shall survive termination.

12. Indemnification

You agree to indemnify, defend, and hold harmless TutorHubBd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the platform
• Your violation of these terms
• Your violation of any third-party rights
• Content you post or transmit on the platform

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. We will notify registered users of material changes via email or platform notification. Your continued use of the platform after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

15. Dispute Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting us. If we cannot resolve the dispute within 30 days, either party may pursue formal resolution through arbitration in accordance with the rules of the Bangladesh International Arbitration Centre (BIAC).

16. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and TutorHubBd regarding your use of the platform, superseding any prior agreements or understandings.
