1. Definitions

• "Platform" refers to the TutorHubBd website and mobile application.
• "Tutor" refers to an individual registered on the platform to provide tutoring services.
• "Student" refers to an individual registered on the platform to receive tutoring services.
• "User" refers to any individual who accesses or uses the platform, including tutors and students.
• "Services" refers to all features, content, and functionalities offered on the platform.

2. Account Registration

To access certain features of the platform, you must create an account. You agree to:

• সঠিক, বর্তমান এবং সম্পূর্ণ রেজিস্ট্রেশন তথ্য প্রদান করুন
• আপনার অ্যাকাউন্টের তথ্য promptly বজায় রাখুন এবং আপডেট করুন
• আপনার লগইন তথ্য গোপনীয় এবং সুরক্ষিত রাখুন
• আপনার অ্যাকাউন্টের কোনো অননুমোদিত ব্যবহার সম্পর্কে আমাদের অবিলম্বে জানান
• আপনার অ্যাকাউন্টের অধীনে ঘটে যাওয়া সমস্ত কার্যকলাপের জন্য দায়ী থাকুন

You must be at least 18 years old to create an account. If you are under 18, you may use the platform only with the involvement and consent of a parent or legal guardian.

3. User Conduct

আমাদের প্ল্যাটফর্মের ব্যবহারকারী হিসেবে, আপনি নিম্নলিখিত বিষয়গুলি না করতে সম্মত হন:

• যেকোনো প্রযোজ্য আইন, বিধিমালা বা তৃতীয় পক্ষের অধিকার লঙ্ঘন করা
• মিথ্যা, বিভ্রান্তিকর বা প্রতারণামূলক তথ্য প্রদান করা
• কোনো ব্যক্তি বা সত্তার ছদ্মবেশ ধারণ করা বা আপনার সম্পর্ক ভুলভাবে উপস্থাপন করা
• অন্যান্য ব্যবহারকারীদের হয়রানি, হুমকি, ভয় দেখানো বা ক্ষতি করা
• কোনো আপত্তিকর, মানহানিকর বা বৈষম্যমূলক বিষয়বস্তু পোস্ট বা প্রেরণ করা
• Interfere with or disrupt the platform's security or functionality
• প্ল্যাটফর্মের কোনো অংশে অননুমোদিত অ্যাক্সেস পাওয়ার চেষ্টা করা
• যেকোনো অবৈধ বা অননুমোদিত উদ্দেশ্যে প্ল্যাটফর্ম ব্যবহার করা
• স্প্যামিং, ফিশিং বা অন্যান্য প্রতারণামূলক কার্যকলাপে জড়িত হওয়া
• প্ল্যাটফর্মের কোনো অংশ রিভার্স ইঞ্জিনিয়ার, ডিকম্পাইল বা ডিসঅ্যাসেম্বল করা

4. Tutoring Services

টিউটরদের জন্য:

• আপনি প্রতিনিধিত্ব করেন যে আপনি আপনার প্রোফাইলে তালিকাভুক্ত যোগ্যতা, অভিজ্ঞতা এবং credentials ধারণ করেন
• আপনি পেশাদারিত্বের সাথে এবং আপনার সর্বোত্তম ক্ষমতা অনুযায়ী টিউটরিং সেবা প্রদানে সম্মত হন
• আপনাকে সমস্ত সেশনের সময় পেশাদার আচরণ বজায় রাখতে হবে
• একজন স্বাধীন সেবা প্রদানকারী হিসেবে আপনি আপনার নিজস্ব কর বাধ্যবাধকতার জন্য দায়ী
• পূর্ব সম্মতি ছাড়া আপনি আপনার টিউটরিং বাধ্যবাধকতা অন্য ব্যক্তির কাছে স্থানান্তর করতে পারবেন না

শিক্ষার্থীদের জন্য:

• আপনি নির্ধারিত টিউটরিং সেশনে সময়মতো উপস্থিত হতে সম্মত হন
• You must provide at least 24 hours' notice for cancellations
• আপনি বুক করা সেবার সাথে সম্পর্কিত সমস্ত ফি পরিশোধ করতে সম্মত হন
• আপনাকে সমস্ত মিথস্ক্রিয়ায় টিউটরদের প্রতি শ্রদ্ধাশীল আচরণ বজায় রাখতে হবে

5. Fees and Payments

প্ল্যাটফর্মের নির্দিষ্ট বৈশিষ্ট্যগুলির ব্যবহারে ফি প্রদানের প্রয়োজন হতে পারে:

• লেনদেন নিশ্চিত করার আগে সমস্ত ফি স্পষ্টভাবে প্রদর্শিত হয়
• SSLCommerz-এর মাধ্যমে পেমেন্ট নিরাপদে প্রক্রিয়া করা হয়
• Subscription plans auto-renew unless cancelled before the renewal date
• প্ল্যাটফর্মে বর্ণিত আমাদের রিফান্ড নীতি অনুযায়ী রিফান্ড পরিচালনা করা হয়
• আমরা যুক্তিসঙ্গত নোটিশ সহ আমাদের ফি কাঠামো পরিবর্তনের অধিকার সংরক্ষণ করি
• অন্যথায় উল্লেখ না করা থাকলে সমস্ত ফি প্রযোজ্য কর সহ অন্তর্ভুক্ত

6. Cancellation and Refund Policy

• সেশন: Students may cancel a session up to 24 hours before the scheduled time for a full refund. Cancellations within 24 hours may be subject to a fee.
• সাবস্ক্রিপশন: You may cancel your subscription at any time. Access will continue until the end of the current billing period.
• রিফান্ড প্রক্রিয়াকরণ: Approved refunds will be processed within 5-10 business days to the original payment method.

7. Intellectual Property Rights

The platform and its original content, features, and functionality are owned by TutorHubBd and are protected by international copyright, trademark, and other intellectual property laws.

• আমাদের স্পষ্ট লিখিত সম্মতি ছাড়া আপনি আমাদের প্ল্যাটফর্ম থেকে পুনরুৎপাদন, বিতরণ, পরিবর্তন বা ডেরিভেটিভ কাজ তৈরি করতে পারবেন না
• Content posted by users (tutor profiles, reviews, etc.) remains the property of the respective user, but you grant us a license to display and distribute it on the platform
• আমাদের নাম, লোগো এবং ব্র্যান্ড উপাদান আমাদের ট্রেডমার্ক এবং অনুমতি ছাড়া ব্যবহার করা যাবে না

8. Privacy and Data Protection

Your use of the platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the platform, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

আইন দ্বারা অনুমোদিত সর্বোচ্চ পরিমাণে, TutorHubBd কোনো পরোক্ষ, আনুষঙ্গিক, বিশেষ, ফলস্বরূপ বা শাস্তিমূলক ক্ষতির জন্য দায়ী হবে না, যার মধ্যে সীমাবদ্ধ নয়:

• মুনাফা, ডেটা, ব্যবহার বা সুনামের ক্ষতি
• সেবা বিঘ্ন বা কম্পিউটারের ক্ষতি
• বিকল্প সেবা সংগ্রহের খরচ
• আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরের যেকোনো বিষয়

Our total liability for any claim arising from these terms or the use of the platform shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding:

• The platform's uninterrupted or error-free operation

• টিউটরদের দ্বারা প্রদত্ত টিউটরিং সেবার গুণমান, নিরাপত্তা বা বৈধতা

TutorHubBd is a marketplace platform connecting tutors and students. We do not directly provide tutoring services and are not responsible for the conduct of tutors or students during sessions.

11. Termination

আমরা যেকোনো সময় আপনার অ্যাকাউন্ট স্থগিত বা বাতিল করার অধিকার সংরক্ষণ করি:

• এই পরিষেবার শর্তাবলী লঙ্ঘন
• প্রতারণামূলক, অপমানজনক বা অবৈধ কার্যকলাপ
• ফি পরিশোধ না করা
• দীর্ঘ সময় নিষ্ক্রিয়তা
• আমাদের একক বিবেচনায়, কারণ সহ বা ছাড়া

Upon termination, your right to use the platform ceases immediately. Sections 5, 7, 9, 10, 12, and 14 shall survive termination.

12. Indemnification

আপনি TutorHubBd, এর কর্মকর্তা, পরিচালক, কর্মচারী এবং এজেন্টদের থেকে উদ্ভূত কোনো দাবি, দায়, ক্ষতি, লোকসান বা ব্যয় থেকে ক্ষতিপূরণ, রক্ষা এবং ক্ষতিহীন রাখতে সম্মত হন:

• প্ল্যাটফর্মের আপনার ব্যবহার
• এই শর্তাবলীর আপনার লঙ্ঘন
• কোনো তৃতীয় পক্ষের অধিকার আপনার লঙ্ঘন
• আপনি প্ল্যাটফর্মে পোস্ট বা প্রেরণ করা বিষয়বস্তু

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. We will notify registered users of material changes via email or platform notification. Your continued use of the platform after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

15. Dispute Resolution

Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting us. If we cannot resolve the dispute within 30 days, either party may pursue formal resolution through arbitration in accordance with the rules of the Bangladesh International Arbitration Centre (BIAC).

16. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and TutorHubBd regarding your use of the platform, superseding any prior agreements or understandings.
